The Rationing of Our Healthcare

In our last post we explained that 35-years ago the U. S. Supreme Court unanimously ruled that the rationing of healthcare is “the very point of private health insurance.” Yet to this day insurance companies won’t tell us how they do it. In fact, their incessant advertising doesn’t leave room for any message other than the care we need will be there whenever we need it.

So, we are faced with a dilemma. On one hand, we need health insurance to have any hope of getting the healthcare we are all likely to need at some point in life. On the other hand, the U. S. Supreme Court has ruled that our private health insurance can deny us the very healthcare we need.

The only exception to this dilemma is Medicare and Medicaid where care and coverage are guaranteed in law. Medicare Advantage, on the other hand, is simply private insurance that the Government purchases for those opting out of original Medicare. Consequently, Medicare Advantage is subject to the same rationing that’s present in the private health insurance one gets from an employer or purchases directly from an insurance company. In fact, the rationing under Medicare Advantage has gotten so bad that hospitals across the country are increasingly refusing to accept it.

I recently I attended a sales presentation on Medicare Advantage where the presenter went to great lengths to list all the benefits his plan offered. In addition, he continually referred to the plan as Medicare. So, I asked him: 1.) Why was he calling it Medicare when Medicare Advantage is nothing more than private insurance that the government purchases for an individual, and 2.) Why wasn’t he explaining that the benefits he was citing for Medicare Advantage can be denied by the insurer. The Presenter simply explained that while I was right on both counts, Medicare Advantage has other advantages. The woman sitting next me gave me a sharp elbow and whispered, “I thought an assurance of care and coverage is why we get insurance.”

The point is that the U. S. Supreme Court has empowered private health insurance companies to ration healthcare and they have had 35 years to get damn good at it. Furthermore, they have done an absolutely magnificent job of keeping us in the dark when it comes to knowing how it’s done.

How many times have we heard of an individual fighting with their health insurance to get the care their doctor says they need? And, if you are like most of us, you just assumed the insurer is in the wrong. However, the insurer was likely doing nothing more than what the Supreme Court has allowed them to do. In short, they were acting WITHIN their authority to ration healthcare.

Fortunately, there is a readily available solution for anyone willing to take just a few minutes to understand the scam that private health insurance is using to ration healthcare. In fact, it’s much like the old shell game (three cups and a pea). As long as we don’t know where the pea is, the scam works. However, the moment we understand where the pea is, the scam collapses.

We need to apply that same logic here. We need to remember that the Supreme Court only empowered insurers to “INDUCE” doctors and hospitals to ration our healthcare. Which is the “slight-of-hand” that insurers are using to hide the pea in their shell game for rationing our healthcare. For, while the insurer and their in-network provider want us to believe the issue is all about coverage, nothing can be further from the truth. The issue is all about the obligation that a provider has to render the care
OUR doctor says we need — regardless of whether the insurer is willing to approve and cover it. That’s right! An in-network provider has contractually agreed to provide the care you and I need even if they have to provide it for “FREE.” Because, that is exactly what the Provider Contract, that every in-network provider signs, requires them to do. Which means we have found the pea that private insurers want so desperately to hide.
